Misyar Marriage

Salamu Alaikum Shaikh i have a question regarding Misyar Marriage
i read a lot of Juristic Opinions/Conditions about Misyar Marriage but i would like to see some Ahadeeth in support of this marriage and where this marriage is mentioned literally so could you provide some ahadith if they exist in support of Misyar Marriage

There is nothing like Misyar marriage. In fact, it is a type of Mut’aa-temporary marriage which has been forbidder by the Nabee himself on the day of Khaibar, and Ulamaa have unanimously agreed to the prohibition of this type of marriage. It is narrated on the authority of Sabrah Al-Juhani that he was with Allaah’s Messenger when he said, “O people, I had permitted you to contract temporary marriage with women, but verily Allaah has forbidden it till the Day of Qiyamah. So he who has any of such women with temporary marriage should set her free and do not take back anything that you have given to them. (Saheeh Muslim, Kitabunnikaah).

    can you please clarify what is meant by misyar? it seems you have likened it to the mut’ah (temporary marriage). what i would like to know is what is the ruling on a man and woman getting married in which the wife forgoes some of her rights such as the right to accommodation and time and she is pleased with this as she might be rich and able to provide for herself? is this type of nikah valid according to the hanafi madhhab?

    Misyar is a marriage based on clauses and conditions that are not islamic and is actually going against the command of ALLAH.Nafaqah(spending),sukna (residence) and mahr(dowry) are conditions stipulated by ALLAH in the qur’aan. If conditions such are made then these conditions are in total violation of ALLAH’S command.If a woman offers this out of her own free will then it will be permissible. However to make nikaah with such conditions is not correct and if nikaah is made then these conditions fall away and the command of ALLAH has to upheld.
    The whole misyaar marriage is based on desire where a man only wishes to fulfill his desires without responsibilites, just like mut’ah. Also if there are children born to the couple what happens then???
    Anyway if nikah takes place it will be valid but these conditions are haraam and will fall away.
