Ive read in the Fatawa al Hindiyya, Kitab al-Siyar, Matters about Murtad – Alfazi Kufur about Quran:
“The one who says: “Falak and Nas are not from the Quran” doesnt become a Kafir.
Cause there is no IJMA, that these two Surahs are from the Quran. The Mutakkhirun said: “…he becomes Kafir.” But the saying of the Mutakkhirun doesnt annulate the Ijma of the Muqaddimun.”
How can this be? We say, the one who declines only one letter from the Quran, becomes a Kafir! And how can somebody decline two whole surahs and doesnt become a Kafir?? And how can there be no IJMA when the Quran is revealed Mutawatir?? How can this be, I dont understand that.
What you read is in Al-Fatawa Al-Bazzaziyah and not in Al-Fatawa Al-Hindiyyah. The text concludes that there has been Ijma’ over Mu’awwazatayn being from the Glorious Qur’aan and therefore whoever does not believe them from the Glorious is Kafir. It was Sayydianaa Abdullah Ibne Mas’ud (رضى الله عنه)who was of the opinion that the Mu’awwazatayn have been revealed for a specific purpose of Ta’wwuz-seeking Allaah’s protection and not as part of the Glorious Qur’aan. He might not have heard these Suraah from the Nabee of Allaah ﷺor they were not reached him with authentic sources. Therefore, he did not consider them from the Glorious Qur’an and hence did not record these two Suraah in his Mashaf. But he latter was convinced and agreed with the Jamaat of Sahabah that the Mu’awwazatayn are part of the Qur’aan. So it is the Ijma’ of Sahabah that the Mu’awwazatayn are from the Glorious Qur’aan. Therefore, whoever does not believe them as part of the Qur’aan is out of the fold of Islaam.
