Erection of Walls and Building Around Graves

I have mentioned above the prohibitions given by Rasulullah salalahu alayhi wa salam regarding the erection of walls etc. around the graves. Our Ulama i.e, the Ulama of the Ahlus sunnah have in the light of these traditions given decrees that these actions are haraam “unlawful”. Imaam Muhammed Rahmatullahi alayh who is a student of imam Abu Hanifa rahmatullahi alayh and who has codified the teachings of Imaam Abu Hanifa rahmatullahi alayh says:

We do not regard it lawful to throw more soil on a grave than that which has come out of it, and we regard it makrooh to make the surfaces of the graves solid…. Rasulullah salalahua layhi wa salam has prohibited us from building around graves and has also forbidden us from making the graves solid. This is our teaching and the opinion of Imaam Abu Hanifa (Kitaabul Aathaar pg96)

Since Rasulullah salalahu alayhiw a salam commanded Hadhrat Ali Radhiallahu anhu to flatten those graves which had been raised… Imam Shafi rahmatullahi alayh says

‘In light of this hadeeth I have seen the Ulama of Makkah giving orders of demolishing buildings erected around graves. ‘ (Nawawi Commentary of Muslim pg312 Vol1)

From the above we learn that the Auliya were innocent of these shrines, tombs and buildings erected at their graves. i They did not acknowledge these shrines, tombs and buildings neither did they allow it nor reuest it.

The Materialist leaders and people are responsible for this. They have invented these customs, which are contrary to the teachings of Rasulullah salalahu alayhi wa salam. Today many people regard these practices as the only means of gaining the guardianship and friendship of Allah.

There exists many people who use the nefarious practice purely as a business venture, and people fall prey to their evil.

All the hanafi books of jurisprudence eg. Alamgiri, Quadi Khan, Durre Mukhtaar, Kabiri etc. Have termed these actions as unlawful. Allamah ibn Aabideen Shaami Rahmatullahi says

‘I have not seen anybody permitting these actions’ (Durre Mukhtaar pg237 Vol2)

And Qazi Thana-ullah Panipatti Rahmatullahi alayh says:

“These acts which people do i.e the building of large walls, buildings, domes, burning of lamps etc. are all haraam” (Mala Budda Minhu pg84)

  1. it was earlier mentioned in this post about the difference between ulamas regarding the erection of walls over the graves … so what exactly r the differences?? and if ulamas r in dis agreement of a concept will that mean take it as u judge it ?? I mean to say any person appraising or opposing a concept will avail the proof . so which one would a layman have to consider ?? An ulama who opposes the beautification of the graves or one who considers it lawful?

    Dear Brother in Islaam, there is no difference amongst the Ulamaa of Ahlussunnah Wal-Jama’h concerning the prohibition of erecting walls over the graves. It is Haraam to erect walls and buildings around the graves.
    As regard to following Ulamaa in the case of differences, apply the same principle that you follow when there are differences amongst the prescription of doctors and the advises of advocates. As you search for an experienced and skilful doctor and advocate do the same for Ulamaa as well. After an honest search and inquiry when you get a true and experienced Alim, follow him in all the religious affairs.

  2. Mash’allah very nice article.

    But I facing some problem in understand. Recently, my very close relative had die. When we buried him, the issue arises his grave was above the floor. It means as it was not easy to dig the ground so the walls were build up. so the total size of depth was 1 foot below the surface and 2 1/2 above the surface.

    Now we are concern if rainy season came up the water could demage the outer walls. So there is no other way except to cement the walls from the outer side and from the upper side corner.

    Please advice us is that right to do? I’m sure you give an advice as soon as possible.

    It is obligatory to dig the ground and bury the deceased in normal condition as Allamah Ibn Abideen Shami has narrated the consensus of Ulaam on this issue. (Raddul Muhtaar Alaad-Durril Mukhtaar, Matlabun Fee Dafnil-Mayyeet) Therefore, the burial obligation will not be excused by placing the deadbody on the ground and making grave erecting walls around. All who were present should make sincere Taubah for not accomplishing the burial in the manner it has been commend.

    It is not necessary to keep such grave intact since the Nabee of Allaah commanded Syyedina Ali to flatten those graves which had been raised. Imaam Muslim has recorded on the authority of Jabir that the Nabee of Allaah forbad from making graves solid or using them as sitting places or erecting walls around them. (Saheeh Muslim, Babun Fee Dafnil Mayyeet)

  3. I have second question. As I don’t no where to post the question except this place. Please accept my ignorance.

    Que: My relative was very old man he lived with us, during his last two years he use to take off his lowers pajama and we brothers, ever watch it rush and tie up.

    Some times our eyes goes to his pvt part… we never watch it with purpose but it was some thing uncontrollable. Now we are worried is that sin to watch it? As we don’t do it purposly please advice us how to repent.

    For posting a query, click on ‘Ask Mufti online’, scroll down and the write the question. The answer to your question is as follows:
    It is not permitted to gaze at the Satr of someone except in the case of extreme necessity. Therefore, it would not be regarded a sin if you immediately turn the eyes away after they fall suddenly on his private part when tying the Pajamah.
