Registration of Nikah in India
Q. What is the ruling concerning the registration of Nikaah? Should Muslims abide by this registration? Abdullah, India
A. The registration of Nikaah is not necessary, but the presence of two matured Muslim men or one man and two women, who can listen to the Ijaab (proposal) and Qabool (acceptance) of the couple, is necessary for the validity of Nikaah in Islam. (Shami: 2/319) Therefore, it would be inessential formalities in the view of Islamic Shariah to ask someone to register his/her Nakaah. But as far as the law of land is concerned, it should be abided by if it is not in line with Islamic Shariah. And the registration of Nikaah does not contradict Islamic Shariah. Therefore, Muslims should register their Nikaah not to validate it but to abide by the law of land. And Allah knows the best,
Muslims attitude towards Danish Cartoons
Q. What should be the attitude of Muslims towards Danish Cartoons? Explain in the light of the Glorious Qur’an and Ahadith.
Abdur Rahman, India
A. Whatever has been happening in the form of defaming Islam and insulting the Prophet Muhammad (SAWS) is an affliction through which a Muslim should be patient and a great devotee of the Prophet (SAWS) abiding by his lifestyle and kicking against the others. A sweet fruit lies in patience as the Prophet (SAWS) is reported to have said, “How strange is the matter of a believer, there is good in all his affairs, and this is only for the believer. If something good happens to him and he is grateful, then this is good for him, and if a calamity befalls him and he is patient, then this is also good for him.” (Muslim)
Therefore, a Muslim should not be emotional by this sort of situation but he should tackle them with wisdom and tolerance, turn to Allah Subhananhu Wa Ta’ala with sincere repentance and follow the lifestyle of the Prophet (SAWS) in every sphere of life. We should sink our differences and gather under one umbrella for the sake of religion. Allah Subhanahu Wa Ta’ala says, “And hold fast, all of you together, to the cable of Allan, and do not separate”. (Al-Imran, 3:103) And Allah knows the best,

He replied: When you meet him, salute him; and when he calls you, respond to him; and when he seeks advice, give him advice; and when he sneezes and praises Allah, respond to him; and when he falls ill, visit him; and when he dies, attend his funeral”. (Muslim) And Allah knows the best,

Reciting Qur’an looking at the scripture in Taraweeh prayer
Q. What Islamic Shariah says regarding the recitation of the Glorious Qur’an looking at the scripture in Taraweeh prayer?
Aftabuddin Qasmi, Saudi Arabia
A. A Musalli who is not Hafiz of the whole Qur’an or does not memorize from the Glorious Qur’an even what is required to recite in Salaah and takes the Glorious Qur’an in his hands or puts it in front of him and recites looking at the scripture and turning its pages while performing Salaah, the Salaah will be invalid. But if the Musalli is Hafiz of the whole Qur’an or at least memorizes what is required to recite in Salaah and does not take the Glorious Qur’an in his hands but puts it in front and recites from the scripture looking at it only, the Salaah will be valid, but Makruh because of the similarity to the Ahle Kitab (people of book) who look at their scripture while saying prayer. (Shamee: 1/461, Aalamghiri: 1/ 101) Allah knows the best
Masjid constructed on the state-land
Q. What is the status of a Masjid constructed on the state-land without permission and a Masjid situated in the road and the Govt. is going to expend the road. Can Masjid be demolished?
Arshad Qayyum, Pakistan
A. The place identified once as a Masjid will remain a Masjid till the Day of Qiyamah whether Salaah is performed at that place or not, the structure of the Masjid stands or falls. It cannot be used for any other purpose except worship. (Raddul Muhtaar Ala Durril Mukhtaar, 3:406) The same rule would be applied to the Masjid referred to the above-mentioned question if the Govt. was aware of the construction but did not prohibit, neither verbally nor practically. But if the Govt. was not aware and the Masjid was built without taking permission then it won’t be regarded as a Masjid. It will be just a place of worship. However, the people of that locality should leave no stone unturned to get the place from the Govt. And after receiving, endow it to the Masjid. And Allah knows the best,
